The product purchased — a WordPress theme or extension from the Lyvira range, hereinafter “the Product” — is published by Mada Link Services, hereinafter “the Publisher”, and sold under licence. By installing or using the Product, the buyer, hereinafter “the Licensee”, accepts the following terms.

1. Purpose

The licence grants the Licensee a non-exclusive, non-transferable right to use the Product, within the limits set out below. The Product is not sold: it is licensed. The Publisher remains the owner of all intellectual property rights.

2. Scope

One licence covers one production domain name, together with its working copies — development, staging, testing — on an address the Product recognises as such.

On a WordPress multisite network using subdirectories, the sites share the same domain: one licence covers the network. With subdomains, each subdomain counts as a domain, and therefore as a licence.

A child theme of the delivered theme does not count as an additional licence: the licence covers the declared site, including when it uses a child theme of the delivered theme, and that site continues to receive the parent theme’s updates.

The licence is issued as a key, to be entered in the Product. The key is personal to the Licensee and must not be shared.

3. Rights granted

install and use the Product on the covered site;
customise it — colours, texts, images, pages, settings — for their own use, including through a contractor acting on their behalf;
receive updates for twelve months from the date of purchase, then continue using the last version received with no time limit.

The end of the update period never disables the site or its bookings.

4. Prohibitions

resell, rent, lend, sub-licence or redistribute the Product, in whole or in part, modified or not, free of charge or for payment;
use it on a site not covered by a licence;
remove or alter ownership, licence or trademark notices;
use the “Lyvira” trademark, the logos or the demonstration visuals to designate another product or service.

5. Open-source components

The Product runs within WordPress and WooCommerce, distributed under the GNU GPL v2 or later. The PHP portions of the Product that call, extend or derive from WordPress or WooCommerce are, for that reason and to the extent required by the GPL, distributed under the GNU GPL v2 or later.

The stylesheets, scripts, images, illustrations, icons, texts, translations, documentation, manuals and demonstration data delivered with the Product are original works of the Publisher: they are not derivative works of WordPress and remain subject solely to articles 1 to 4.

Any third-party libraries bundled with the Product keep their own licence, stated in their files.

6. Support

The Publisher provides email assistance on installing and using the Product for the duration of the update period, on working days and hours, within the limits of reasonable use. It covers neither bespoke development, nor conflicts caused by third-party extensions, nor modifications made to the Product’s code by the Licensee.

7. Warranty and liability

The Product is supplied “as is”. The Publisher warrants that, on the date of purchase, it works with the versions of WordPress, WooCommerce and PHP stated in its lyvira-compatibility.json file. To the extent permitted by law, the Publisher’s liability is limited to the price paid for the licence.

The Licensee remains responsible for the legal compliance of their site — legal notices, rental terms, data protection, payment methods: the demonstration texts delivered are examples to be replaced.

8. Termination

The licence terminates automatically in the event of a breach of article 4. The Licensee must then stop using the Product and delete every copy of it.

9. Governing law

This licence is governed by French law. Failing an amicable settlement, the courts of the Publisher’s registered office have jurisdiction. A consumer may refer the matter to the consumer mediator named in the legal notice.

This licence is written in French. Translations are provided for the Licensee’s convenience; in the event of any discrepancy, the French version prevails.
